Terms of service
These terms govern your use of the HeartBeatNo1 app and website. By creating an account you agree to them. Please read them carefully.
Who we are
HeartBeatNo1 is operated by HeartBeatNo1 B.V., established in the Netherlands. Our entity and contact details are at the bottom of this page.
Eligibility and age
You must be at least 18 years old, or the age of majority in your country, to create an account. By registering you confirm that you meet this requirement and that the information you provide is accurate.
Your account
You are responsible for keeping your password secret and for activity under your account. Do not impersonate others and do not share your login. Tell us promptly if you suspect unauthorised use.
Acceptable use
You agree not to use HeartBeatNo1 to post unlawful, hateful, harassing, deceptive or infringing content, to spam, to scrape the service, or to abuse other users. We may remove content and suspend accounts that break these rules. See our community guidelines for details.
Your content and licence
You keep ownership of the content you create. You grant us a limited, worldwide, royalty-free licence to host, display and share that content as needed to operate the service, for example showing your wish to the people in your circle. You are responsible for the content you post.
Wishes and contributions
Wishes and contributions let people support each other. Contributions are voluntary. HeartBeatNo1 is a platform that facilitates these payments through Mollie and never owns the money flowing between users. We do not guarantee that any wish will be funded or fulfilled.
Payments
Payments and contributions are processed by Mollie. One-off purchases and subscriptions bought through the Apple App Store or Google Play are billed by those stores under their own terms. Prices are shown before you confirm.
Subscriptions and auto-renewal
Premium subscriptions renew automatically until you cancel. When you subscribe through the App Store or Google Play, the subscription auto-renews unless you turn off auto-renewal at least 24 hours before the period ends, and you manage and cancel it in your store account settings. Affiliate links
Some product links are affiliate links. If you buy through them we may earn a small commission at no extra cost to you. This never changes the price you pay. See our affiliate disclosure.
Third-party services
The service relies on third parties such as Mollie, app stores, hosting providers and affiliate partners. Their terms apply to their part of the service, and we are not responsible for their products or websites.
Intellectual property
The HeartBeatNo1 name, logo, design and software are owned by HeartBeatNo1 B.V. You may not copy or reuse them without our permission.
Disclaimers
The service is provided on an as-is basis. We do our best to keep it available and accurate, but we do not guarantee that it will always be uninterrupted or error-free.
Liability
To the extent permitted by law, HeartBeatNo1 is not liable for indirect or consequential damage. Nothing in these terms limits liability that cannot be limited under Dutch law, including for intent or gross negligence.
Termination
You can delete your account at any time in the app. We may suspend or end your access if you break these terms. You can also withdraw within the legal cooling-off period as described on our refunds page.
Governing law
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, without affecting any mandatory consumer rights you have where you live.
Changes
We may update these terms as the product evolves. We will post the new version here and, for significant changes, notify you in the app.
